Terms of Service

These terms cover the PRV8 Android apps provided by NETWORKFX, Inc., a company registered in Wyoming, USA (“networkfx”, “we” or “us”). By installing or using an app, you agree to these terms. If you use an app for your organization, you confirm that you may accept these terms on their behalf.

The general terms apply to every app. Each app also has its own section:

• PRV8 5G Connect Lite for Android
• PRV8 Backup Calling for Android
• PRV8 5G Connect for Android

Paid work, such as Pilots, white-label builds, SIM enablement, SIM provisioning and MNO engagement, is covered by a separate agreement with your organization. If that agreement conflicts with these terms, that agreement applies.

General terms

Who the apps are for

The apps are workplace tools for Private Cellular Networks. They are not directed at children.

Your license

We give you a limited, non-exclusive, non-transferable license to install and use the apps on phones and tablets you own or control, for as long as you follow these terms. We and our licensors keep all other rights, including the PRV8 and networkfx names and logos. Open-source components in the apps stay under their own licenses.

Acceptable use

You agree not to:

• use an app on a SIM, network or device you are not authorized to use;
• use an app to break the law or to interfere with a network or its users;
• copy, resell or redistribute an app, or remove its notices;
• reverse engineer an app, except where the law gives you that right.

What the apps need

Features that change network settings work only on a compatible phone with a SIM/eSIM provisioned with access rules for apps signed by PRV8. Without such a SIM, those features change nothing. Requirements for each app are on its product page and store listing.

Networks and services we don’t provide

We make software. We don’t provide mobile service, network coverage, SIMs for use with your MNO, or a Private Network. Your organization, your network operator and your MNO are responsible for those services, and their terms and charges apply. You are responsible for using your network, spectrum and devices in line with the laws and licenses that apply to them.

The apps can change which networks, network types and APNs a phone uses. Your organization is responsible for choosing settings that suit its deployment, and for testing them before relying on them.

Emergency calls

The PRV8 apps are not an emergency calling service. Emergency calling depends on the phone, its SIMs and the networks in range, and a phone set to use a Private Network may behave differently from a phone on an MNO alone. Your organization should test emergency calling on its devices and make sure users have another way to reach emergency services.

Prices

The PRV8 apps on Google Play are free. Paid work is priced in your organization’s agreement with us.

Test builds

Pilot and test builds may be limited to a set period and can stop working when it ends. They are provided for evaluation and may contain errors.

Privacy

Our privacy policy explains what each app reads, what can leave your device and what we receive.

Updates and availability

We may update, change or withdraw an app or a feature. Android, phone makers, MNOs and app stores can also change how an app works, and an older version may stop working.

Warranty

To the extent the law allows, the apps are provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that an app will work on every phone, SIM or network, or that it will be uninterrupted or error-free.

Liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, data, service or business. Our total liability for any claim about an app is limited to the greater of what you paid for that app in the 12 months before the claim and US$100.

Nothing in these terms limits liability that the law does not allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.

Consumers in the EEA and UK

networkfx acts as a trader for its apps on Google Play. If you are a consumer in the European Economic Area or the United Kingdom, you keep the rights your local consumer law gives you, and nothing in these terms takes those rights away. The warranty and liability sections apply to you only as far as that law allows, and you may bring a claim in the courts where you live. To raise a complaint, contact us using the details below.

Ending these terms

You can stop at any time by uninstalling the app. We may end your license if you break these terms. The sections that by their nature should continue, including warranty, liability and governing law, continue after that.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict of laws rules. Disputes go to the state or federal courts located in Texas. This doesn’t affect the mandatory rights of consumers described above.

Changes to these terms

We may update these terms and will change the date at the top of this page when we do. If a change is significant, we will give notice on this page or in the app. If you keep using an app after a change takes effect, the new terms apply.

PRV8 5G Connect Lite (Android)

PRV8 5G Connect Lite applies a Private Network’s PLMN, RAT and APN settings to the SIM your organization issued, and shows whether they are in place. It is free on Google Play.

• Its built-in settings are for the networks described on its store listing. Other networks need a white-label build.
• Install only one PRV8 network app per phone. Don’t install it alongside PRV8 5G Connect.

PRV8 Backup Calling (Android)

PRV8 Backup Calling carries a dual-SIM phone’s MNO calls and texts over a Private Network’s data, using the MNO’s own encrypted connection. It is free on Google Play.

• It needs a dual-SIM phone with access rules on both SIMs, and an MNO line that supports Wi-Fi Calling.
• Your MNO provides the calling and messaging service. Its terms and charges apply, and it can change or stop the service.
• Results depend on the phone, the MNO and the network. Not every phone can complete a move between paths, and calls may drop.
• The app does not route emergency calls. Android handles them. See Emergency calls.

PRV8 5G Connect (Android)

PRV8 5G Connect is a field tool for setting a Private Network’s PLMN, RAT and APN, viewing live metrics, running site surveys and creating reports. It is free on Google Play.

• Survey and diagnostic results are measurements from one phone at one moment. Check them before relying on them for design or compliance decisions.
• Speed tests use mobile or Wi-Fi data, and your provider’s charges may apply.
• Install only one PRV8 network app per phone.
